Business and Commercial Services

Arkansas keeps its UCC records at the Secretary of State, in the Business and Commercial Services division, usually shortened to BCS. Its office is in the Victory Building on West Capitol Avenue in Little Rock. One thing to know up front: the state says it is moving UCC services to a new online filing platform.

The wider office is in the Arkansas office guide. To see what a lien search shows, read our UCC search guide and the UCC-1 filing guide.

Where do you search Arkansas UCC records?

The UCC online filing portal is at bcs.sos.arkansas.gov. The Secretary of State says that once the transition is done, all UCC filings, searches, bulk data requests and XML filing will run only through the new system. Check the UCC page on the state site before you start, in case the link or the login has changed.

The online service was built with the Information Network of Arkansas. The state lists search results as instant, and a filing's position is granted immediately when it is accepted.

How much does a search or copy cost?

A search costs $6.00, and the state charges it whether or not there are results. On paper, the UCC-11 lien search with a certificate is also $6.00. A copy of a financing statement is $6.00 for the first page and 50 cents for each page after that.

That makes a search with one copy about the same as two searches. Plan for it if you are checking several debtor names.

What does it cost to file a UCC-1?

The UCC-1 national form is $16.00. That price holds online and on paper, and it includes the right to terminate the filing. On paper, each additional page is 50 cents, up to a maximum charge.

Other items:

  1. A UCC-3 for an amendment, assignment, continuation or partial release is $6.00.
  2. A termination of an older filing, made before July 28, 1995, is $6.00.
  3. A termination of a newer filing has no separate fee.
  4. A UCC-5 correction statement is $6.00 on paper.

Present names exactly as they should appear. The state enters debtor and secured party names into its system as they are presented. Use letter size paper, with all information on the front only.

What is different about Arkansas?

Filings used to be recorded with county circuit clerks. When they moved to the Secretary of State, each got a new state filing number, and the old county numbers stopped working in the central database. The circuit clerk may still charge you for certified copies held at the county.

Arkansas also has a charging application for LLC members. A judgment creditor files it with a court order, and the filing creates a temporary lien on the member's interest in the LLC. That filing is made through the Secretary of State.

Online or paper, and how long does it take?

The state lists savings as a reason to file online: no postage, no paper forms and no mail delays. Online UCC-3 filings need an imaging setup that can handle document uploads, so check with the office if you plan to continue or amend online. The pages we read give no fixed turnaround for mailed filings. For questions, the office lists a toll free line, 1-888-233-0325.

If you want a hand preparing a filing, you can ask our private filing service. State fees are separate, and you can file with the Secretary of State yourself.
